I acknowledge and accept that as a participant in a N Creative, Inc. [aka Juneau Photo Tours, and hereafter referred to as N Creative, Inc.] workshop, day tour, private or group instruction, or guided hike; I take full responsibility for my behavior, well being, and health throughout the booked photography workshop, day tour, private or group instruction, or guided hike, which may involve a variety of activities, unfamiliar locations, and modes of locomotion, including but not limited to: climbing, running, or walking for a longer period of time than I am used to, physical exertion for which I may not be prepared, and weather extremes subject to sudden and unexpected change. I further acknowledge and accept that the tour may involve walking through unfamiliar, narrow, unpaved and/or steep paths, gangways, bridges, roads, stairways and driveways, and transportation in a variety of vehicles including but not limited to vans, motor coaches, and air or watercraft. I also acknowledge and accept that my participation in this activity may expose me to an airborne virus or illness. I knowingly and willfully accept all risks associated with a N Creative, Inc. photography workshop, day tour, private or group instruction, or guided hike, and agree to hold neither N Creative, Inc., its officers, agents, representatives, employees or tour guides [hereafter referred to as “Staff”] liable in any way should any harm come to me.
I acknowledge that the enjoyment and excitement of the proposed form of tour is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I agree that if I suffer injury or illness, N Creative, Inc. or its Staff can, in accordance with their level of training and certification, provide first aid or at their cost, arrange any medical treatment and emergency evacuation service as it or they deem necessary for my health and safety. Further, I agree that at all times during the tour, I will abide by and comply with any additional instructions given by the tour guide or any other Staff and accept that non-compliance may result in injury, death or permanent disability. I understand that non-compliance may result in my removal from the tour.
By reserving a N Creative, Inc. photography workshop, day tour, private or group instruction, or guided hike, I enter into this Liability Waiver, and am not relying on any oral, written nor visual representations or statements by N Creative, Inc. or its Staff or any other inducement or coercion to go on the photography workshop, day tour, private or group instruction, or guided hike. I confirm that, by my own free will, I have read and understand the Terms and Conditions of the Liability Waiver and agree that this Liability Waiver will be binding upon my heirs, next of kin, executors, administrators and successors now and in the future.
In addition, I agree to a model release and grant N Creative, Inc. a worldwide, royalty-free license to use my photographic, video, or digital likeness solely for promotional and educational purposes.
This Photography Tour Liability Waiver supersedes any other agreements or representations by or between the parties and is governed by the laws of the State of Alaska and is intended to be interpreted as broadly as possible. I agree that exclusive jurisdiction and venue for any legal action shall be in the Alaska Court System, whether Superior or District Court, or the United States District Court for the District of Alaska. If any part of this agreement is determined to be unenforceable, all other parts shall be given full force and effect.
